PATENTS FOR INVENTIONS |
A patent is a registrable documentary right created by the patent attorney in a patent specification based on an invention by the client. The rights are not in the invention, but rather are in the document to the extent that document complies with the Patents Law and is written to best advantage. The notion of what can be protected by a patent varies widely (see for example Patent No 686542) and a patentability opinion and associated advice should be sought while an invention is still secret, and even if secret, advice should be sought before making an offer for sale or hire or any commercial use. Generally speaking secret use of a commercial nature is "public use" under the Patent Law and can prevent a valid patent being obtained in Australia on a patent application filed later. (Note other countries have different requirements.) |
DESIGNS FOR ARTICLES |
A Design Registration is a registrable right in design features of an article. Unlike a patent which is able to protect general function or idea a design registration is limited to the overall impression as depicted in drawings of the article registered. The protection available is narrow. Click on the case below to see an example where the Court found that there was no infringement. Although this decision was under the previous legislation it illustrates the limits of this form of protection Firmagroup and B&D. |
TRADE MARKS |
A trade mark registration provides the owner with exclusive rights to the "idea" of the registered "sign" for the registered goods/services. The rights extend to closely related goods/services although this extension does not apply where the alleged infringer can prove that the public are not confused or deceived by co-existence of the marks in question. Generally speaking a "sign" is anything capable of identifying and generally excludes ordinary descriptions but includes words, logos, smells and sounds. A dramatic example of the power of a trade mark registration is in the Dial an Angel case. Intellepro have successfully applied this case to infringements of the Willy Wheely Bin registration. |
